1. Overview
This Privacy Policy outlines how Orpyx® Medical Technologies Inc. and affiliates (“Orpyx,” “we,” “us,” or “our”) collects, uses, shares, maintains, and protects personal information. It applies to www.orpyx.com, si-dashboard.orpyx.com, and other sites where this policy is posted, as well as mobile applications linked to this Privacy Policy (the “Site” or “Sites”). We encourage you to read this Privacy Policy, and the Terms of Use. Orpyx must collect and process your personal information to provide you with our services.
Please note, the Sites may link to third-party websites that are not operated by Orpyx. This Privacy Policy does not cover third-party websites, and we are not responsible for their content or privacy practices. Always review the privacy policies of third parties before providing your information or visiting those sites.
Orpyx’s Sites include the mobile application (the “App”), the public website (the “Website”), the cloud-based health management system (“the Cloud”), and the dashboard healthcare providers use to monitor patients (the “Dashboard”). Each serves different purposes, and personal data may be handled differently on each platform. Please read the relevant sections for a description of how your information is collected and used.
Orpyx collaborates with healthcare providers to identify patients who may benefit from using the Orpyx services based on their health needs. In some cases, the App is used by Users on behalf of Patients. A “Patient” refers to someone using Orpyx sensory insoles for medical purposes, and their data is entered into the App (“Patient Data”). A “User” refers to anyone entering data on behalf of a Patient, including the Patient themselves, or a guardian, friend, or relative involved in the Patient’s care. Unless otherwise noted, the term “User” or “you” refers to both Users and Patients.
Orpyx is committed to safeguarding personal information in compliance with applicable privacy laws, including Alberta's Personal Information Protection Act (“PIPA”), Canada’s Personal Information Protection and Electronic Documents Act (“PIPEDA”), and, for U.S. residents, the Health Insurance Portability and Accountability Act (“HIPAA”) and applicable state privacy statutes.
By using the Orpyx system or consenting to this Privacy Policy, you consent to the collection and processing of your personal and health-related information as described in this policy.
2. Understanding Orpyx Technology
The Orpyx system includes a sensory insole (“Device”) designed to monitor foot pressure and temperature, helping to prevent foot injuries in at-risk individuals. The Device captures pressure, foot temperature, mobility data, and other relevant patient data ("Patient Data") and transmits the Patient Data to the App. The App collects and may store this data, and sends the encrypted Patient Data to the Cloud for remote monitoring purposes via the Orpyx Dashboard. Patient Data is encrypted when it is sent from the App to the Cloud, when it is stored in the Cloud, and when accessed via the Dashboard.
3. Collection of Personal Information
We collect personal information in the following situations:
- When you create an account with us or complete our online forms
- When you contact us via email, phone, text, as part of an order for products or services, or other communication methods
- When you request information or assistance through the Sites
- When Patient Data is transmitted to our data repository
- When your healthcare provider shares your health data with Orpyx, such as when your healthcare provider sends prescription details or other relevant health information associated with your care plan or medical history
- When you subscribe to Orpyx newsletters, attend Orpyx webinars, or purchase Orpyx products/services
- When you create a candidate profile in our job applicant tracking system.
Personal information collected may include:
- Name, email, username, password, address, phone number, date of birth, insurance details
- Information related to your treating physician or healthcare facility
- Any other details you provide in your profile, or communications to Orpyx
- Data entered into the App by Users or on behalf of Patients.
- OPT IN CONSENT: By submitting your phone number, you are authorizing to send you text messages and notifications. Message/data rates apply. Reply STOP to unsubscribe to a message sent from us.
When using the App, we may collect technical data about your mobile device, such as:
- Mobile device type, operating system, software version number, IP address
- A unique device identifier (such as your device IMEI number, MAC address of the device's wireless network interface, Device serial number, or the mobile phone number used by the device)
- Usage data (e.g., meter errors, log files)
- Location data, country, language code and time zone settings
- Analytic data (e.g., App usage statistics, data on links clicked, websites visited before or after you visit the App, pages viewed, time spent on each page)
- Technical information about related software, hardware and peripherals that are internet or wireless-based to provide you with and improve App functionality
- Date and time Patient Data is collected or transmitted.
This information helps us evaluate the App's performance and improve our services.
4. Use of Personal Information
We use personal information, alone or in combination with other data, for purposes such as:
- Providing Orpyx products and services, including Device, App and cloud-based health management tools, as applicable
- Providing customer support
- Assisting in your treatment, providing insights to healthcare providers
- Improving and testing the functionality of our Sites and technology
- Ensuring the security and performance of our Sites
- Analyzing data and conducting research
- Communicating with you about reminders, updates, informational surveys, or product recommendations
- Enforcing our Terms of Use and Privacy Policy
- Conducting marketing and promotional activities
- Determining and improving the effectiveness of disease management techniques, therapies, treatments and costs
We may also use statistical, aggregated, or anonymized data for product development or research purposes (including case studies, white papers, journal publications, etc.). We do not sell this data.
Marketing
We may contact you with marketing communications if you've given consent. You can opt out at any time by contacting us at info@orpyx.com or using the unsubscribe link in our marketing communications. We will continue to send you non-marketing information, such as updates or safety notifications to our technology via App notifications. No mobile information will be shared with third parties or affiliates for marketing or other promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. You can manage push notifications in your mobile device settings.
5. Disclosure of Personal Information
We may share your personal information with:
- Your healthcare provider directly or via the Orpyx Dashboard
- Service providers who help us deliver Orpyx products and services to you
- Service providers for onboarding, testing, development, support, and maintenance of our Sites and services
- Researchers evaluating or improving the performance of our technology or disease management techniques/therapies/treatment
- Companies involved in marketing and customer outreach
- Credit card processors and billing services, for payment processing, if applicable
- Prospective buyers in the event of a business sale
- Distributors and selected partners (with your consent)
Personal information is disclosed only as necessary to provide services and is not sold.
Mergers and Transactions
If Orpyx undergoes a merger, acquisition, or sale, your personal information may be transferred as part of that transaction in accordance with the law.
Legal Requirements
We may disclose your information to meet legal or regulatory obligations, or in circumstances where it is necessary to protect the safety of users or the public.
6. Storage and Retention
Personal information is securely stored in Canada or the U.S. and may be subject to local laws, which may grant government or security authorities access in certain cases. Orpyx retains personal information until:
- We no longer need the information for the purpose(s) it was collected;
- All legal requirements related to the data, including legal retention periods, have been fulfilled
- You ask us to delete the data. Note that if we require the data to fulfill certain business functions, or to comply with law, we are not able to delete the data even if you ask us to.
Orpyx uses organizational, administrative, technical, and physical safeguards to protect your personal information from unauthorized access or loss. However, no method of transmission is 100% secure, and we cannot guarantee complete security such as sharing information via text, or in the case of interception during transit, lost or stolen devices, or unauthorized access. Users are responsible for securing their accounts with strong passwords. Contact us immediately if you suspect unauthorized access to your account.
7. Cookies and Tracking Technologies
We use cookies to track site activity and improve user experience. You may adjust your browser settings to block cookies, but some features of the Sites may not function without them. We also use third-party services like Google Analytics to analyze website traffic.
8. User Rights
You have the right to:
- Request access to or correction of your personal information.
- Object to or restrict data processing.
- Request deletion of your data, subject to legal or business requirements.
Requests can be made by contacting support@orpyx.com. Requests will be processed within 45 days, subject to verification of identity. We will process your request in compliance with applicable laws.
9. Children's Privacy
Our Sites are not intended for children under 13. We do not knowingly collect information from children under 13. If you believe we have collected such information, please contact us to remove it.
10. Changes to Policies
We may update this document periodically. Continued use of our Sites or technology constitutes acceptance of the revised policies.
